Terms & Conditions

These terms form the agreement between you and Nurse Excellence Academy.

1. Who you are contracting with

This website and its products are operated by Nurse Excellence Academy. By purchasing or using our services you are entering into an agreement with Nurse Excellence Academy.

2. Acceptance

By accessing the site, creating an account, or continuing to use our services, you agree to these terms. If you do not agree, please stop using the service. If you are agreeing on behalf of a facility or organisation, you confirm you have authority to bind it; if you are agreeing as an individual, you confirm you are of legal age.

3. What we provide

Nurse Excellence Academy sells digital educational products only: pre-recorded on-demand video training, downloadable toolkits, templates and printable pocket guides (PDF), and web-based educational calculators and checklists for long-term care nursing teams. All products are delivered instantly online through your account. We do not sell physical goods, medical devices, medications, healthcare services, staffing services, consulting or advisory services, coaching, onsite or virtual engagements, or any regulated professional service. Nothing on this site is sold as a service performed for a customer.

No certification, credential, or continuing education: our courses are self-paced educational content. We are not a certification body, training provider, or accredited education provider. We do not test, assess, credential, certify, or license anyone, we do not issue certificates, badges, diplomas, or CE contact hours, and nothing we sell qualifies you for any licence, registration, or professional designation. Knowledge checks inside a course are self-study tools only and are not graded examinations.

Not medical advice: our content, calculators, and checklists are educational resources. They do not diagnose, treat, or provide medical advice for any individual patient, and they support — and never replace — professional clinical judgement, your facility's policies, or applicable regulations. You remain responsible for clinical decisions and documentation.

4. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account.

5. Licence and restrictions

We grant you a limited, non-exclusive, non-transferable right to access and use the materials you have purchased, within the plan or licence you selected. Individual licences are for one nurse; facility and organisation licences cover the seats specified at purchase.

You may not:

  • resell, redistribute, publish, or share purchased materials outside your licence;
  • reverse engineer the service or circumvent technical or access limits;
  • share account access or download links with people outside your licence.

6. Acceptable use

You must not misuse the service, including by:

  • using it for unlawful purposes;
  • engaging in fraud, spam, or misrepresentation;
  • infringing the intellectual property or privacy rights of others;
  • uploading malware, probing or scanning our systems, or scraping the service.

7. Your content

You keep ownership of notes, uploads, and other content you submit, and you grant us a limited licence to host and process it solely to provide the service. Do not upload protected health information or resident-identifiable data.

8. Intellectual property

Nurse Excellence Academy retains all rights in the service and its content, including videos, toolkits, templates, pocket guides, software, and branding. If you believe content on the site infringes your rights, contact us through our contact page and we will review and, where appropriate, remove it. Repeat infringement may result in termination.

9. Service level

We work to keep the service available and accurate, but we do not guarantee uninterrupted or error-free performance. Content reflects our understanding of guidance at the time of publication and may not reflect the latest regulatory changes.

10. Payment and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Every product we sell is a one-time purchase. We do not sell subscriptions, memberships, or plans that renew automatically. Payment, billing, tax, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for the conditions that apply to digital products.

11. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your access ends; where practical we will give you a reasonable window to download materials you purchased before removal.

12. Warranties and liability

To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Our total aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing excludes liability for fraud, death, or personal injury where such exclusion is not permitted by law.

13. Indemnity

You agree to indemnify Nurse Excellence Academy against claims arising from your content, your unlawful use of the service, or your breach of these terms.

14. General

You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of the seller's jurisdiction, and disputes will be handled by the courts of that jurisdiction. We may update these terms and will update the "last updated" date above.
